01 The Service

EnigmaAI lets you chat with advanced AI models through a zero-knowledge architecture. All conversations are stored only on your device in an encrypted local database. We maintain a strict zero-log policy: we do not collect, store, or access your chat history, prompts, or responses on our servers.

The App includes:

• Free tier with standard usage limits
• Pro subscription (paid in-app purchase) that provides higher message limits, premium AI models and higher web search limits

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

02 Pro Subscription

• You may purchase a Pro subscription via in-app purchase through the Apple App Store (on iOS / iPadOS) or the Google Play Store (on Android), depending on the platform on which you use the App.
• Pro unlocks higher limits on messages, access to premium AI models and web search features.
• Subscriptions automatically renew unless canceled through your Apple App Store or Google Play account, as applicable.
• All payments are processed by Apple (App Store) or Google (Google Play), depending on your platform. We do not receive, process, or store your payment card details or other billing information.
• Refunds are governed by the refund policy of the platform through which you purchased the subscription (Apple’s App Store policy or Google Play’s policy, as applicable). We do not offer direct refunds.

03 User Accounts and Eligibility

No account registration or login is required. You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App.

04 User Responsibilities and Prohibited Conduct

You agree not to:

• Use the App for any illegal, harmful, or abusive purpose
• Attempt to reverse-engineer, decompile, or interfere with the App’s Blind Routing or encryption systems
• Overload or abuse our proxy infrastructure
• Submit prompts that violate third-party AI providers’ policies
• Impersonate others or engage in fraudulent activity

We may suspend or terminate your access if you violate these Terms.

05 AI-Generated Content and Images Disclaimer

The AI models accessible through the App (including ChatGPT, Grok, Claude, DeepSeek, GPT Image 2, the Uncensored AI model, and any other models, image-generation services, or AI providers made available now or in the future) may produce inaccurate, incomplete, biased, misleading, inappropriate, infringing, offensive, explicit, or harmful content, including but not limited to text, images, code, visuals, or any other media.

EnigmaAI, Dark Matter Lab, LLC, and their respective officers, directors, employees, and agents have no responsibility or liability whatsoever for the accuracy, reliability, legality, originality, suitability, safety, or any other characteristic of any content generated by these third-party AI providers. All such outputs are provided solely by the respective providers under their own terms and policies.

Uncensored AI — Specific Disclaimer. The Uncensored AI model (and any similarly unfiltered, “uncensored”, or unrestricted model that may be added to the App in the future) is, by design, an unfiltered third-party model that operates without the safety guardrails, content filters, or moderation layers used by mainstream AI providers. Outputs from the Uncensored AI model may include content that is sexually explicit, violent, profane, offensive, controversial, biased, factually wrong, or otherwise objectionable, and may include information that is unlawful in some jurisdictions. By choosing to use the Uncensored AI model you acknowledge and accept these risks. EnigmaAI, Dark Matter Lab, LLC, and their respective officers, directors, employees, and agents expressly disclaim any and all responsibility and liability for any output, response, image, or other content generated by the Uncensored AI model, and for any consequences arising from your use of, reliance on, or sharing of such output. You are solely responsible for ensuring that your use of the Uncensored AI model is lawful in your jurisdiction.

You use the App and all AI-generated content and images entirely at your own risk. We do not endorse, guarantee, review, or assume any liability for any AI output. You are solely responsible for:

• Verifying any information or content;
• Ensuring your prompts and use of outputs comply with all applicable laws; and
• Any consequences, claims, damages, or legal issues (including intellectual property infringement, defamation, privacy violations, or harm) arising from your use of, reliance on, or sharing of AI-generated text, images, or other content.

We expressly disclaim all liability for any such claims. This disclaimer applies equally to text outputs, generated images, vision/OCR outputs, and any other multimedia content produced by or returned through the App.

06 Intellectual Property

The App, its design, Blind Routing technology, and all related content are owned by or licensed to Dark Matter Lab, LLC. You are granted a limited, non-exclusive, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, or distribute the App.

All AI responses are owned by the respective third-party providers or you (subject to their terms).

07 Third-Party AI Providers

The App routes your prompts to third-party AI services (including OpenAI, xAI, Anthropic, DeepSeek, the provider of the Uncensored AI model, and any additional AI providers added to the App from time to time). These providers process your prompts and any uploaded media according to their own terms and privacy policies. We have no control over their services, models, content moderation (or lack thereof), or data practices. Links to their policies are available in our Privacy Policy.

The App handles all AI access internally — you do not need to provide any API keys.

08 Disclaimers and Limitation of Liability

The App is provided “as is” and “as available” without warranties of any kind. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including any loss of data, profits, or AI output inaccuracies, and including without limitation any claims arising from AI-generated content, images, or outputs of any kind.

Our total liability shall not exceed the amount you paid for the Pro subscription in the twelve months preceding the claim (or $10 if you have not paid anything).

09 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your violation of these Terms or your use of the App.

10 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

11 Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a new “Last Updated” date. Continued use of the App after changes constitutes your acceptance of the new Terms.

12 Termination

We may terminate or suspend your access to the App at any time for any reason. You may stop using the App at any time by uninstalling it.

13 Apple App Store — Additional Terms (iOS / iPadOS)

The following additional terms apply only when you download, install, or use the App on an Apple-branded device obtained through the Apple App Store. In the event of any conflict between these additional terms and the other provisions of these Terms, these additional terms control with respect to your use of the App on Apple-branded devices. As used in this section, “Apple” means Apple Inc.

1. Acknowledgment. You acknowledge that these Terms are concluded solely between you and Dark Matter Lab, LLC, and not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
2. Scope of License. The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where permitted.
3. Maintenance and Support. Dark Matter Lab, LLC is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
4. Warranty. Dark Matter Lab, LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Dark Matter Lab, LLC.
5. Product Claims. Dark Matter Lab, LLC, and not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App’s use of the HealthKit and HomeKit frameworks, if applicable.
6. Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Dark Matter Lab, LLC, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the App (for example, the terms of any third-party AI providers referenced in Section 07).
10. Third Party Beneficiary. You and Dark Matter Lab, LLC acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
